Next Greatest - Waiver of Liability

1. Acknowledgment of Risk

You understand and acknowledge that participation in lacrosse training, coaching, and related activities inherently involves physical risks. These risks may include, but are not limited to:

You acknowledge that despite the best efforts of coaches and the platform, these activities come with inherent risks, and you voluntarily assume all such risks associated with participation.

2. Assumption of Risk

By using Next Greatest to book training sessions or engage in any coaching-related services, you voluntarily assume all risks associated with participation. This includes, but is not limited to, the risk of injury, accidents, or damage to property. You agree that you will not hold Next Greatest, its employees, agents, or affiliated coaches responsible for any injury, damage, or loss arising from your participation in any session or service booked via the platform.

3. Release of Liability

In consideration of being allowed to access and use the services provided by Next Greatest, you agree to release and hold harmless Next Greatest, its officers, directors, employees, agents, coaches, and affiliates from any and all claims, liabilities, damages, costs, or expenses arising from:

• Injury or harm caused during coaching or training sessions.
• Accidents or incidents that occur during training, whether in the presence of the coach or otherwise.
• Any damage or loss resulting from the use of the Platform's services or participation in training sessions.

This release applies to any liability arising from the actions, negligence, or omissions of Next Greatest or the coaches using the platform.

4. Coach Responsibility

Coaches using Next Greatest are responsible for the safety, supervision, and well-being of their athletes during coaching sessions. Coaches are expected to:

• Provide safe, effective, and responsible coaching in accordance with their qualifications and experience.
• Ensure that athletes are prepared for physical activity, including any necessary warm-ups or safety precautions.
• Hold the appropriate certifications (e.g., CPR, first aid, coaching qualifications) and adhere to any relevant regulations or safety guidelines.
• Not conduct any activities that could endanger the safety of athletes or other individuals.

By participating in the Platform, coaches agree to take full responsibility for the sessions they conduct and any injuries or incidents that occur during those sessions.

5. Indemnification

You agree to indemnify and hold harmless Next Greatest, its affiliates, employees, agents, and coaches from any claims, liabilities, damages, and legal actions arising from:

• Your participation in any coaching or training activities arranged through the Platform.
• Any injury or damage caused during the course of training or coaching.
• Any violation of the Platform's Terms of Service or conduct that causes harm to others.

This indemnification includes legal defense costs incurred in defending any claims related to your participation in the Platform.

6. Medical Treatment

In the event of an injury during training, you give consent to Next Greatest and its coaches to seek appropriate medical treatment on your behalf if necessary. You agree to cover any costs associated with medical care, including transportation to a healthcare facility.

7. Dispute Resolution

In the event of any dispute, claim, or controversy arising from this Waiver of Liability or participation in coaching/training services, both parties agree to resolve the issue through mediation or binding arbitration, rather than through litigation. This process is intended to resolve conflicts in a timely and cost-effective manner, while avoiding the need for a court trial.

8. Governing Law

This Waiver of Liability and any related claims shall be governed by and construed in accordance with the laws of the jurisdiction in which Next Greatest operates, without regard to its conflict of law principles.

9. Coach-Athlete Agreement

Both coaches and athletes/parents understand and agree that the Next Greatest platform is simply a matchmaking service and that Next Greatest does not have control over the content of the sessions or the quality of the coaching provided. Therefore, all parties agree that:

• Coaches will act in good faith and to the best of their abilities.
• Athletes/Parents will abide by the coaching rules and guidelines set by the coach, respecting the safety measures and expectations outlined by the coach.

10. Acknowledgment and Consent

By using the Next Greatest platform, both athletes/parents and coaches confirm that they have read, understood, and voluntarily agree to the terms of this Waiver of Liability. You acknowledge that you are waiving certain legal rights, including the right to pursue legal action for any injuries or damages that may occur during coaching sessions.
